Refund Policy

1. Overview

Land Motives LLC operates as a real estate investment and wholesaling company. Because we deal in real property transactions rather than retail goods, our "Refund Policy" primarily governs earnest money deposits (EMD), contract cancellations, and escrow disbursements.

2. Earnest Money Deposits (EMD)

When we enter into a purchase agreement with a seller or an assignment agreement with an end buyer, an Earnest Money Deposit is typically held by a licensed third-party title or escrow company. The disbursement or refund of the EMD is dictated by the terms of the specific written contract.

3. Due Diligence Period

Most of our purchase agreements include a standard Due Diligence or Inspection period. If a contract is terminated by either party within this specified timeframe in accordance with the contract terms, any deposited funds will be refunded or disbursed exactly as outlined in the agreement.

4. Contract Cancellation by Seller

If you are selling your land to us and choose to cancel the agreement before the expiration of the due diligence period, the transaction will be nullified without penalty, provided it complies with the termination clauses in the executed purchase agreement.

5. Contract Cancellation by Land Motives

If Land Motives LLC discovers major title defects, unrecorded liens, zoning issues, or severe environmental restrictions during the due diligence period, we reserve the right to cancel the contract. In such cases, no funds will be owed to the seller.

6. Title and Escrow Issues

If a transaction fails to close due to an uninsurable title, probate issues that cannot be resolved, or the seller's inability to convey clear and marketable title, the contract is voided. Any EMD held in escrow will be refunded to the depositor.

7. Default and Breach of Contract

In the rare event of a breach of contract by either the buyer or the seller outside of the allowed contingencies, the forfeiture or refund of any earnest money will be handled strictly according to the default provisions of the signed contract and state law.

8. Disbursement Timeframes

When a refund of escrowed funds is authorized, the timeline for receiving those funds is determined by the third-party title company's processing times and banking regulations, typically taking 3 to 7 business days following the execution of a mutual release.

9. Dispute Resolution

Any disputes regarding contract cancellation or the refund of earnest money deposits will be resolved through mutual agreement or, if necessary, mediation or arbitration as defined in the purchase agreement and subject to the laws of the state where the property is located.
